2009—The bait
MAGISTRATE STARK'S 2009 ORDER: Sep. 4, 2009, ORDER re. Interrogatory No. 9 – answer in the present tense. p. 4.

"Facebook is entitled to know every Leader product or service that Leader contends practices any of the asserted claims of the patent-in-suit . . .

Accordingly, IT IS HEREBY ORDERED THAT within ten days of the date of this Order Leader shall supplement its response to Facebook's Interrogatory No.9 to disclose any and all Leader products or services that practice any of the asserted claims of the '761 patent and to identify - product-by-product and service-by-service - which of the asserted claims are practiced by each of these products or services.

[". . . practice any of the asserted claims" is the BAIT—2009 present tense. No order here to discuss past iterations of the invention. No instruction to discuss 2002.]

2011—The switch
OBAMA NOMINEE STARK'S 2011 OPINION: (He ignored his Sep. 4, 2009 Order and threw Leader Technologies under the bus. The trial turned on this action.) Mar. 14, 2011, OPINION re. Interrogatory No. 9, pp. 46, 52.

"Leader contends that its interrogatory responses, given in 2009, were limited to products offered for sale in 2009, and that earlier versions of the product, including those that were the subject of the contested offers for sale prior to the December 10,2002 critical date, did not embody the claimed invention. Notably, however, Leader stated no such qualifications in its actual interrogatory responses."

[Why would they? The Sep. 4, 2009 was clear—present tense—in 2009.]

". . . the combination of Mr. McKibben's trial testimony (which the jury found non-credible), plus his seemingly conflicting deposition testimony (presented to the jury at trial), plus the interrogatory responses (which can reasonably be interpreted as an admission that the invention was ready for patenting prior to the critical date) that, together, are "sufficient" to satisfy Facebook's evidentiary burden. There is nothing impermissible about such an analysis."

[". . . can reasonably be interpreted as an admission that the invention was ready for patenting prior to the critical date" is the SWITCH—can apply to 2002 also.]

[Also, "There is nothing impermissible about such an analysis" is a Freudianly defensive comment from Judge Stark. He appears to telegraph that he is wrong and knows it. The legal question is does "nothing impermissible" rise to the level of Facebook's "clear and convincing" evidence burden of proof? Put another way, is a double negative as the primary argument in support of Facebook by a federal judge clear and convincing, especially a judge who holds financial interests in Facebook, and will benefit personally from decisions favorable to Facebook, not to mention a judge whose nomination was recommended by a Facebook attorney, and whose appointment appears to hang on this ruling as the quid pro quo?]

JUDGE STARK'S BAIT & SWITCH BETRAYED HIS FACEBOOK BIAS.

Judge Stark could not "reasonably" interpret the interrogatory as a 2002 "admission" that the patent was ready for patenting seven years earlier, since he himself had ordered the interrogatory to be answered in the 2009 present tense.

Judge Stark himself confused the jury by allowing Facebook to interpret his 2009 present tense order in the 2002 past tense—seven years earlier. Since this was the ONLY testimony on the subject, Facebook's entire case hung on Judge Stark giving them this past tense interpretation of Interrogatory No. 9. Indeed, Facebook did not produce an expert witness to opine to the state of Leader's 2002 source code, nor did they produce a single witness of the so-called offers. Without a fabricated "inventor's admission" Facebook had nothing. Judge Stark gave it to them on a silver platter.

Judge Stark compounded his bias by stating "[n]or is this an ambiguous situation." The fact is, he and he alone made it ambiguous by ignoring his Sep. 4, 2009 Order. There was no real question of law, nor question of Mr. McKibben's credibility (since no witness contested Mr. McKibben's testimony). Judge Stark's arguments are pure judicial fabrication. Judge Stark was confirming Leader attorney Paul Andre's conclusion a month earlier that Facebook was manipulating the proceedings (see below).

Judge Stark's duplicitous on-sale machinations must be set aside. His dubious on-sale bar opinion, when combined with his substantial Facebook interests, his close relationship to Facebook's attorneys, and his dependence on Facebook attorney Donald K. Stern, Cooley Godward LLP for his appointment, renders his decision invalid according to the Code of Conduct for U.S. Judges.

It should be noted that Judge Leonard P. Stark received his appointment to the bench by President Obama a week after the Leader v. Facebook trial. Another "Handsome Reward," the name Robin Yangong Li, the CEO of Baidu, Inc. ADR—the Facebook look-alike—gave to his Cayman Island holding company for his Baidu stock.
